Former President Joe Biden’s son, Hunter Biden, called Merrick Garland’s appointment as US attorney general the “biggest mistake” his father made in office during an appearance on the “I’ve Had It” podcast on Sunday.
During the show, host Jennifer Welch attacked Garland and the Justice Department under him for not charging President Donald Trump and investigating Hunter Biden. He asked Hunter Biden for his thoughts on what he described as the “capture by Democrats” from Republicans for pushing Garland in the first place.
“One of the things that pisses me off is the Merrick Garland DOJ and not prosecuting Trump. And that they prosecuted you,” Welch said in part as she posed her question.
“My take on this is, and to put it out as best I can, my feelings, is the biggest mistake of my father’s administration of Merrick Garland’s leadership,” Hunter Biden said.

He added, “The reason we’re in the situation we’re in right now is that we can almost … by the way, the buck has to stop with my father. He was the president and he elected him. Now, when he elected him, he played with, you know, a higher standard than the Marquess of Queensberry. He played with the Constitution and the tradition that the president will never, you know, especially since Nixon’s decision to get involved in any decision of the Department. So, I can assure you that there was a separation between church and state there.”
Hunter Biden added another charge to Garland for failing to prosecute Trump for any role in the January 6 Capitol hearings, which he says is a “planned conspiracy” by the Trump administration to undermine the 2020 election.

“[I]f Merrick Garland started a totally 100% legitimate investigation instead of thinking let’s not fan the flames… didn’t you watch what I watched? Did you not see the people attacking the Capitol of the United States of America, beating the police and literally running the congressmen and senators out of the building? Didn’t you see that? “You didn’t see the president and you know it was a concerted and organized effort by them since the day before the election when they knew they were going to leave,” said Hunter Biden.

Both Welch and Hunter Biden also described Garland as a “moderate” and suggested that he was only chosen by President Biden to appeal to Republicans and show favoritism after former President Barack Obama previously denied him a Supreme Court justice.

“Obama is picking this milquetoast candidate. Your father is a decent man, he felt bad about what happened to Merrick Garland. And he played integrity politics. Like, ‘I’m going to make him perfect and make him attorney general.’ Then Merrick Garland gets there, and he’s like, ‘Well, we can’t upset these White Republicans,'” Welch said.

“Big mistake,” Hunter Biden said.
Hunter Biden had previously been under investigation since 2018 under President Donald Trump’s first term. However, he was later forgiven by his father for any crime he “committed or may have committed” since Jan. 1, 2014, to Dec. 1, 2024 during his final weeks in office.
